The law defines cosmetics as products used to beautify, purify or change the complexion, skin, hair or teeth. Thus, a beauty or toilet product is usually classified in the category of cosmetics. How are they regulated in Canada?

On December 1, 2004, the state released the new Cosmetic Regulations. These regulations require the listing of ingredients on the label for all cosmetic products sold in Canada. This, along with other changes to the Cosmetic Regulations, enhances the protection of the health and safety of the Canadian public with respect to the use of cosmetics. The new provisions came into effect on November 16, 2006. This means that companies selling cosmetics must comply with the new requirements. The use of the Cosmetic Consultant is vital here.

Who is covered by this regulation?

The manufacturer must submit a Cosmetic Declaration Form, along with labeling and safety information. The ingredients must be listed according to the INCI nomenclature. The reviews are the ingredients to determine if they meet the requirements.

What if I do not comply?

Only ingredients that do not pose unreasonable risks to the health and safety of the Canadian public when the directions for use are followed may be used in cosmetics. When a cosmetic product can represent a risk to health:
  • The company may be required to provide additional information
  • Tests may be carried out on the product
  • A risk assessment can be undertaken
The different corrective measures are:
  • Reformulating the product or re-labeling the product
  • Remove the product from the market / voluntary recall
  • Refusal of importation
